Plastics Law: Companies may be fined up to S/. 546,000 for non-compliance with the law

The Ministry of Environment (Minam) published this Friday the regulation of the Plastics Law (Law No. 30884), which regulates single-use plastics and disposable containers, establishing heavy fines of up to 130 UIT or S/. 546,000.

Supreme Decree No. 006-2019-MINAM, published in the official gazette El Peruano, establishes economic sanctions in cases of infractions ranging from minor to very serious.

In this sense, it is considered a minor infraction, for example, to be an importer of plastic bags and not provide truthful information in the registry contemplated in the law, which will be sanctioned with a fine of up to 8 UIT (S/. 33,600).

Likewise, a serious infraction, such as handing out plastic bags for free or charging for them below market price, will have a penalty of up to 90 UIT (S/ 378,000).

Very serious penalties include the sale of plastic bags or straws for beverages and food for human consumption on coastal beaches and Amazonian rivers, lakes and lagoons, for which a fine of up to 130 UIT (S/. 546,000) must be paid.

It is worth mentioning that the amount of the fines varies depending on whether the offender is a micro, small, medium or large company.
